Court Rules That Illegal Aliens Have Second Amendment Rights

When Mario Meza-Rodriguez was five years old, his parents brought him into the United States illegally. By the time he was an adult, he managed to get in trouble with the police after getting into a bar fight two years ago. When the police arrested him, they discovered a .22 caliber pistol in his pocket. Even though illegal aliens can’t own firearms under federal law, Meza-Rodriguez argued in court that charging him for possessing the pistol would violate his Second Amendment rights. The court disagreed. He was convicted and deported.

However, the 7th Circuit Court has recently ruled in Mario’s favor, while also upholding his conviction. They believe that the words “the people” in the Second Amendment, apply to everyone in the US, including illegal aliens. At the same time though, they believe that his conviction is still valid since the US government can restrict gun ownership for known law breakers. Mario’s lawyer is challenging their decision on the grounds that it contradicts itself.

Their decision is certainly confusing. Obviously, everyone in this country is supposed to have certain rights regardless of their citizenship status. Even if you’re an illegal, you be can’t be imprisoned indefinitely without trial, you can’t be tortured into a confession, and you have the right to an attorney (at least you did before 9/11). But once you’re convicted, you can lose your rights. If you couldn’t restrict the rights of a known criminal, then you couldn’t punish anyone for anything. If you ask me, it sounds like the 7th Circuit Court is trying to establish a new precedent for illegal aliens.

Republicans were elected in historic numbers in 2014 largely due to their promise to reverse Obama’s illegal and unconstitutional amnesty decree. Predictably, this promise was broken immediately. The consequences will be catastrophic not only for the Republican Party, which at this point there is little reason to support, but for America in general in all walks of life — including regarding the indispensable right to bear arms:

Deportation amnesty is one of the biggest threats to gun rights because it will add millions of anti-gun voters to the electorate in one fell swoop.

The vast majority of illegal aliens are Hispanics, and Hispanics are one of the most anti-gun demographics in the United States. According to the Pew Research Center, 62% of Hispanics prefer expanding gun control to percent gun rights, compared to 39% of white voters.

This is among the many reasons our ruling class is displacing the American population with Third Worlders from across the undefended border. The scope of the treason that we are witnessing makes Vidkun Quisling a patriot by comparison.

The Japanese should have tried illegal immigration.

I don’t know about you, but the senseless death this week of the Canadian soldier, Corporal Nathan Cirillo, who was shot and killed at Canada’s National War Memorial in Ottawa, left me devastated.

When I look at the photograph of him with his dog, I cry as if he were my own son or brother. I cried even more, when I subsequently found out that he left behind a wife and young daughter.

At first, I was in disbelief, then I became angry, then saddened, then angry again. It’s where I find myself now.

US veterans started receiving letters from the government last year informing them that they are disabled and not allowed to own, purchase or possess a firearm. If the veteran does decide to purchase a firearm he will by fined, imprisoned or both. This comes on page 2 of the VA letter.

The majority of US veterans receive basically the same letter. Many of the veterans do not even know the VA declared them incompetent. The targeted veterans say the VA offers an appeals process but then does not share required information.

VA Benefits Administrators are the ones making these declarations against veterans robbing them of their due process rights and arbitrarily submitting their names to the FBI’s NICS database without cause and many times without a veteran’s knowledge.

This is an outrage!

Last April the United States Justice Foundation (USJF) filed a suit against the Obama Administration on behalf of these abused veterans. Katharine Russ reported:

The United States Justice Foundation (USJF) has filed the first lawsuit of what promises to be a string of lawsuits in the US District Court for the Southern District of California against the US Department of Veterans Affairs (DVA) and the Veterans Benefits Administration (VBA)…

…Current policies of the VA have caused more than 129,000 veterans to, arbitrarily, be deprived of their Second Amendment Rights to own firearms without due process simply because they were declared financially “incompetent.”

These arbitrary policies, in no way, consider whether a veteran represents a danger to themselves or to others.

It is, unequivocally, unsound and irrational thinking that sends our young men and women off to war and expects them to come home “whole.” Most veterans experience minor depression, minor PTSD, and even minor short-term memory loss when they return home but can still function- competently.

No court would find them incompetent and strip them of their second amendment rights for such minor diagnoses unless they were proven to be a detriment to society. In some these cases, the VA does not even offer reasons or evidence for such a Determination.

It is outrageous to think that over 100,000 US veterans are the victims of this sort of abuse. US veterans deserve the same Constitutional rights as the rest of us.

U.S. Congressman Jeff Duncan’s communications director told  Joshua Cook, “we’re very concerned and extensively looking into the lead issue.“

After Congress defeated the Democrat led anti-gun bill this year, President  Obama said he would use executive action to promote his gun control  agenda. One of the executive orders signed by Obama  prevents military-grade weapons from being imported into the U.S.

If the President can bypass Congress by using agencies like the EPA  to shut down lead ammunition smelters, and stop lead ammunition imports by  executive order, then you essentially have backdoor gun control.

He lost  his bid for re-election – to a seat he won unopposed  the last time – in  part because he signed up Chambersburg as one of New York  Mayor Michael  Bloomberg’s anti-gun cities.

His Republican opponent, Darren Brown, said he knows one thing he’ll  do  immediately after being sworn in as mayor: “The very, very first  thing I’d like  to do is get Chambersburg off the ‘Mayors Against Illegal  Guns’ list.”

It’s not a surprise.  Gun Registration often leads to confiscation.

A federal court ruled the Obama administration can continue to collect data from gun dealers on certain types of firearms purchases including information on the buyer. Guns Saves Lives reported:

On June 3, President Barack Obama will sign the U.N. Arms Trade Treaty (ATT).

The ATT passed in the U.N. General Assembly by a vote of 153-4 on April 2.

This treaty is ostensibly aimed at putting an end to gun trafficking across international boundaries, and both Breitbart News and the NRA have argued that it will eventually require an international gun registry in order to be enforceable.

What If Obama Signs the UN Arms Trade Treaty?

The UN Arms Treaty is again, rising to the surface. The latest version was  finalized this past March 2013.

It needs to be clearly understood that the United States does not need the  UN. So one might reasonably ask, what is the purpose of America signing any of  the UN-sponsored treaties?

When any country signs onto a UN treaty, that country effectively gives up a  some sovereignty by placing itself under the auspices of the United Nations. In  effect then, certain laws of a particular country could eventually become  infringed or entirely canceled out because of that position.
