Fed Appeals Court Protects “Habitual Drunkards” from Deportation

In what may seem like a bad joke, a U.S. federal appellate court has ruled that an illegal immigrant convicted of drunk-driving can’t be deported because federal immigration law discriminates against “habitual drunkards” like him.

The case involves an illegal immigrant from Mexico, Salomon Ledezma-Cosino, with at least one drunk-driving conviction, possibly more. Ledezma-Cosino has lived in the U.S. illegally since 1997 and has eight kids, five of them anchor babies born in America. He works in the construction industry and has a criminal record. Ledezma-Cosino drank about a liter of tequila every day for a decade, according to medical records cited in federal court documents, and has been diagnosed with acute alcoholic hepatitis and cirrhosis of the liver. This man should be the poster child for deportation yet he remains in the country and is now further protected by a federal appellate court ruling.

That’s because this particular court, the notoriously leftist 9th Circuit Court of Appeals, believes the portion of federal immigration law that should get Ledezma-Cosino removed is discriminatory. For more than five decades a law enacted by Congress has stated that illegal aliens who are not of good moral character can be deported. This includes individuals with serious felony convictions, who have participated in genocide or torture, have two or more gambling offenses or have engaged in prostitution or drug-trafficking. Those who fail to pay court-ordered child support or alimony, smuggle aliens into the U.S., vote illegally or participate in religious persecution and are deemed “habitual drunkards” are also considered to lack the sort of good moral character that can get them removed from the country.

The U.S. government is trying to deport Ledezma-Cosino under the provision that he’s a proven “habitual drunkard.” The removal case dates back to 2008, when Immigration and Customs Enforcement (ICE) detained the Mexican national and began removal proceedings. He appealed for relief and the government determined he didn’t qualify because he lacked good moral character as a habitual drunkard. Keep in mind that the Obama administration has issued a widespread amnesty that protects practically all illegal aliens, so it’s revealing that the government keeps trying to remove this particular man. In its ruling the appellate court blasts the federal measure that associates habitual drunkards with poor morale character, writing that it violates the equal-protection guarantees of the U.S. Constitution because alcoholism is a disease. “The theory that alcoholics are blameworthy because they could simply try harder to recover is an old trope not supported by the medical literature,” the ruling states. “Rather, the inability to stop drinking is a function of the underlying ailment.”

The court further states in its decision that there is no rational basis for classifying persons afflicted by chronic alcoholism as persons who innately lack good moral character, writing that chronic acute alcoholism is itself a disease and a medically determinable physical or mental impairment. “Like any other medical condition, alcoholism is undeserving of punishment and should not be held morally offensive,” the ruling says. “Although people with alcoholism continue to face stigma, private biases may be outside the reach of the law, but the law cannot, directly or indirectly, give them effect. We are well past the point where it is rational to link a person’s medical disability with his moral character.”

If the Obama administration doesn’t appeal this outrageous ruling, Ledezma-Cosino, and other illegal immigrant habitual drunkards like him, can probably stay in the U.S. In the past few years Judicial Watch has reported on—and investigated—cases that illustrate individuals like Ledezma-Cosino are ticking time bombs that can cause a lot of damage. JW sued the Department of Homeland Security (DHS) for records regarding an illegal immigrant, Carlos Martinelly-Montano, who already had multiple drunk-driving convictions when he killed a nun while driving drunk in Virginia. JW is also investigating a DHS cover-up involving an illegal immigrant with multiple drunk-driving convictions who slammed into a couple’s sports utility vehicle in New Mexico, killing their baby. He had been convicted of driving under the influence (DUI) at least three times yet was spared deportation.

Illegal immigrant ordered freed by feds now suspected of murder in Ohio

An illegal immigrant suspected of murdering one woman, wounding another and attempting to rape a 14-year-old girl was released earlier this month by Ohio sheriff’s deputies after U.S. Customs and Border Protection agents told them not to hold him, law enforcement officials said Tuesday.

“I have somebody who we don’t know who he is, why he is in this country, why he is here illegally and why he allegedly committed a murder,” Painesville Municipal Court Judge Michael Cicconetti thundered at Razo’s arraignment, noting the suspect has no green card, birth certificate or driver’s license.

“I can’t set a bond high enough,” he continued. “How in the hell do I even know it’s him?”

Juan Emmanuel Razo, 35, was arrested Monday after a shootout with police following a crime spree police say began with the attempted rape of a girl in a park in Painesville, about 30 miles northeast of Cleveland. He later shot a woman in front of her children and murdered a 60-year-old woman in nearby Concord Township, according to police. While Razo is being held on $10 million bond, authorities are trying to explain why he was allowed to remain in the U.S. illegally after local authorities questioned him just three weeks ago.

Deputies who questioned Razo say Border Protection officials told them Razo is from Mexico and in the U.S. illegally, but said they would not pick him up for deportation. Lake County Sheriff Dan Dunlap said at a news conference that deputies released Razo because he hadn’t committed a crime at that point.

Illegal Immigrant from Middle East Arrested in Texas Burglary

An illegal immigrant from the Middle east was arrested Wednesday during a burglary in Plano.
WFAA reported:

The arrest of a burglary suspect in Plano on Wednesday could represent a break in a string of more than two dozen similar crimes since last October.

Riashat Ishmam, 17, provided authorities with the critical and timely information they needed to make take a man into custody. He had been playing games on the computer when the doorbell rang.

“Thirty seconds later, he starts vigorously knocking on the door,” the teenager said.

Riashat took us through his house and explained how he narrowly escaped an encounter with a burglar.

“I go in and lock the door and I go into the bathroom,” he said, standing on the second floor of his parents’ Plano home.

Riashat didn’t know where the intruder was at the time, but later realized the burglar broke through a back window screen. Plano police would later identify the burglar as Farhood Sani Allahdadi, 28, of McKinney.

Riashat told News 8 that Allahdadi had also broken through the bedroom door with force. The door was shattered around the doorknob.

A panicked teen only had his phone with him — but it was all he needed.

“Since this door doesn’t have a lock, I just stood still after I called 911, and luckily he didn’t even check the bathroom,” Riashat said.

The young man said he heard Allahdadi combing through drawers and moving quickly. But the intruder did not get far, because officers arrived within six minutes of that phone call and picked up Allahdadi as he climbed out the window.

Harvard Gives Student Full Ride After He Tells Them He’s Illegal Immigrant

When Dario Guerrero, an illegal immigrant who found out about his status in high school, told Harvard that he was in the country illegally, the school encouraged him to apply–and gave him a full scholarship after he was accepted.

Writing in the Washington Post, Guerrero, who is currently a junior at the university, said after an MIT official recommended that he not apply to the school during a trip to visit college, he “left the office in a daze” because MIT had been his dream school. He started walking down Massachusetts Avenue” and, “without really planning it, I found myself in the middle of Harvard.” A Harvard admissions officer told him, “If you are admitted to Harvard College, we will meet your full financial need without regard to your legal status.”

He eventually got in, and “they gave me a full ride. This meant I wouldn’t have to worry about student loans or quarterly tuition payments; that I always had a place to stay away from home; that I could travel every semester, on Harvard’s dime, back to California; that my parents would never have to worry whether I’d finish school. Those are luxuries few people, documented or not, ever have.”

“I used to think that being undocumented was a disadvantage to me. I used to mourn the fact that I was different,” the current junior wrote. “But ultimately I realize that it was because of, not in spite of, my identity – as an undocumented Chicano – that I was been able to do what I did. Being something different in the socioeconomic fabric of the United States gave me the perspective I have.”

LUBBOCK, Texas—An illegal immigrant who was released by U.S. authorities with a Notice to Appear has been arrested for the alleged murder of a woman and kidnapping of children on U.S. soil. The alleged crimes occurred after the man was released.

The man, Pedro Alberto Monterroso-Navas, entered the U.S. illegally with children and turned himself in to U.S. Border Patrol agents. He was processed and released, as are all illegal immigrants who come as unaccompanied minors or incomplete family units from Central America. The alien is from Honduras.

The arrest was first reported by the Associated Press (AP), but Breitbart Texas has exclusively confirmed that the man was part of the Obama Administration’s catch and release policy for family groups from Central America.

A U.S. Border Patrol source who spoke with Breitbart Texas on the condition of anonymity provided Breitbart Texas with the alien registration number for the man, and the event number for the man’s apprehension. He was processed in the McAllen station of the U.S. Border Patrol. The alien’s registration number is 202027386. The event number for his apprehension is MCS14061487. The “MCS” designates the McAllen station, the “1406” designates that the man was apprehended in June of 2014. A separate Border Patrol source confirmed that the man was apprehended on June 26, 2014 with two children he claimed were his own. He told U.S. authorities he had family in Metairie, Louisiana.
