Supreme Court Rules You Have No 4th Amendment Protection Against Cops Ignorant of the Law

In a blow to the constitutional rights of citizens, the U.S. Supreme Court ruled 8-1 in Heien v. State of North Carolina that police officers are permitted to violate American citizens’ Fourth Amendment rights if the violation results from a “reasonable” mistake about the law on the part of police. Acting contrary to the venerable principle that “ignorance of the law is no excuse,” the Court ruled that evidence obtained by police during a traffic stop that was not legally justified can be used to prosecute the person if police were reasonably mistaken that the person had violated the law. The Rutherford Institute had asked the U.S. Supreme Court to hold law enforcement officials accountable to knowing and abiding by the rule of law. Justice Sonia Sotomayor, the Court’s lone dissenter, warned that the court’s ruling “means further eroding the Fourth Amendment’s protection of civil liberties in a context where that protection has already been worn down.”

What Constitutes Unreasonable Search? Our Government’s Growing Disregard for the 4th Amendment !

The 4th Amendment states in part, “The Right of the People to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated…” It does not say that it might be violated whenever the White House thinks that it should be violated, or that it can be violated under certain circumstances with an order from a FISA Court. There are enough willful, indiscriminate violations of the 4th Amendment going on in our country right now to make even Russia’s Vladimir “Ras-Putin” blush and prompt the Kremlin to issue a public apology on behalf of the KGB for providing the official role model for our NSA. America is not living up to its reputation as the land of the free anymore, and about the only brave that are left here at home seem to be those politicians who have enough bravado or chutzpah to routinely and regularly violate our Constitution and the Bill of Rights with apparent impunity. The rest of the brave are overseas fighting wars that should have been over by now.

What the hell is the matter with some of the people that we elect and send to Washington to represent us? Do they even know who or what we should actually be afraid of and what we need to be secure from? It’s not a bunch of bearded old men in dirty robes hiding in some faraway cave in south-eastern Afghanistan. It is actually clean shaven domestic culprits in Washington  who are wearing designer suits. They are working the halls of Congress and plotting to destroy many of what’s left of our civil liberties!

There must be a law like Murphy’s Law that states that government agencies with excessive authority inevitably go overboard in their regulations.  Remember the year in the 1980s when the Federal Transportation Agency imposed an ignition device on new cars so that the engine wouldn’t start unless the driver wore his seat belt?

Citizens objected so vociferously that the government quickly reversed itself.

Let’s hope the same thing occurs with the Obama administration’s decision to install invasive “full body” scanners at airports in the United States, and to impose invasive pat-downs for those who uphold their Fourth Amendment rights against “unreasonable searches.”  Americans need to stand up and say, “Enough is enough.”

The Department of Homeland Security (DHS) only seems to lack perspicuity, foresight, basic analytical skills, and senses of humor and irony. Its head, its staff, and its administrator are as distant from reality as Pluto is from the Sun. It has just launched a propaganda campaign called, “If You See Something, Say Something.” They have roused the wrong “enemy” – the American people.
“As Americans head into the busy holiday travel season, it is important to remember that every individual has a role to play in keeping our country safe and secure,” said Secretary Napolitano. “The ‘If You See Something, Say Something’ campaign encourages travelers and those who work in the hotel industry to identify and report indicators of terrorism, crime and other threats to the proper law enforcement authorities.”
Imagine that in Nazi Germany, every German was urged to perform the same “patriotic” duty to keep the country safe and secure. To wit: “If you see a Jew, say something. If you see a gypsy, say something. If you see a Negro, say something. If you see a German curse Hitler, say something.” You get the picture.
