On July 1, 2016 the title of a Washington Times published report, “Nearly 1 million immigrants — including more than 170K convicts — ignoring deportation,” makes clear that the term “immigration law enforcement,” under this administration especially, is an oxymoron.
Reportedly 170,000 of these aliens have serious criminal histories and pose an immediate threat to the residents of the towns and cities where they live and may continue pursuing their criminal “careers.” “Sanctuary cities” that shield them from detection by the federal government may attract these aliens, thereby endangering their decent law abiding residents. A recent article published by the Discovery Institute, “Sanctuary Cities Can Provide Safe Havens For Terrorists,” focused on the threats sanctuary cities pose to national security and quoted from one of my recent commentaries.
My recent article, “Obama’s Victims: Released Criminal Illegals Commit Rape, Murder, Molestation” explained how the administration’s malfeasance has undermined public safety and has resulted in more innocent people being assaulted and killed.
The laws of nature are immutable; the speed of light does not depend on a cop with a radar gun and a summons book. Our legislated laws, however, are meaningless and worthless if they are not enforced.
Law enforcement is a labor-intensive job. In order for law violators to be punished for their transgressions their crimes need to be discovered and they need to be identified. It is essential that an adequate number of law enforcement officers are “out there” to do this work and to make the physical arrests.
Today there are likely fewer than 3,000 ICE (Immigration and Customs Enforcement) agents actually enforcing our immigration laws. More than half of the estimated 6,000 ICE agents are dedicated to enforcing our customs laws which have nothing to do with immigration law enforcement. To put this in context, there are more than 20,000 Border Patrol Agents, more than 45,000 employees at the TSA. NYC has more than 35,000 police officers protecting the “Big Apple.”
Simply stated, in this life and death “game” of hide and seek, there are precious few agents seeking an overwhelming number of aliens who are hiding.
There are fewer than 300 immigration judges who hear immigration cases. It was recently disclosed that on those all-too-rare occasions when an illegal alien is arrested, it may take two years for that alien to have his deportation (removal) hearing. Most of these aliens are not kept in custody and often simply disappear. Many times such aliens will find the opportunity to engage in a marriage — often a fraud marriage, to remain in the United States. There are agents available to uncover such fraud scams.
For years our political leaders, from both political parties, have attempted to focus the debate about immigration on securing the border that is supposed to separate the United States from Mexico.
Most assuredly, this violent and porous border can and must be made secure. It is an easily achieved goal. Let us not forget that what may have been “Mission Impossible” for lesser nations and their citizens, that for America and Americans there are virtually no such impossible missions. For Americans the most difficult of challenges are, at worst, “Mission Difficult” and ultimately create opportunities.
Consider that more than 100 years ago the United States constructed the Panama Canal and achieved enumerable other technological successes since the construction of that canal.
It was an American test pilot, Chuck Yeager, piloting an American-made aircraft, the X-1 that first exceeded the speed of sound nearly 70 years ago.
America repeatedly landed men on the moon more than 40 years ago, bringing all of those intrepid astronauts home safely, an act yet to be achieved by any other nation on even a single such mission of discovery and exploration.
Several American-made spacecraft are currently hurtling out of the solar system having flown by all of the outer planets of the solar system.
We can go on to list dozens of “firsts” that are attributable to the genius, ingenuity and creativity of America and its citizens that are the envy of the world. Certainly securing a border is not an overwhelming task. However, as my mom used to say, “Where there is a will, there is a way.”
All too many of our elected “representatives” have, where the effective enforcement of our immigration laws are concerned, have however stated, “No way!”
They are adamantly determined, that under no circumstances, will they support the measures we desperately need to create an immigration system that possesses the integrity and resources to protect America’s national security and the lives and jobs of Americans.
At best they seek to create the illusion of cynically “solving” the immigration crisis through extremely costly measures that would not only not succeed, but actually make the situation far worse. As I have previously noted, Comprehensive Immigration Reform should be more properly referred to as the “Terrorist Assistance and Facilitation Act” because it would enableto unknown millions of illegal aliens, who entered the United States surreptitiously, be granted lawful status and official identity documents without so much as an interview, let alone an actual field investigation being conducted.
Consequently there would be absolutely no way to verify the true identities of these aliens or even when they actually entered the United States. Aliens participants in this legislative betrayal against America and Americans could easily lie about their identities and when they actually entered the United States to comply with any entry date deadline that might be imposed.
Immigration fraud and visa fraud were identified by the 9/11 Commission as a key method of entry and embedding by terrorists, and not only those terrorists who participated in the attacks of September 11, 2001.
Once legalized these aliens would be able to file petitions for their minor children and their spouses to be legally admitted into the United States, flooding our nation and our schools with millions of new students who lack English language proficiency. Schools that are failing now would simply implode under this added stress.
Aliens who have criminal histories or know that our government has intelligence about their connection to criminal or terrorist organizations would simply remain in “the shadows” and there would be no resources made available to locate and arrest them. So much for the myth that Comprehensive Immigration Reform would make us safer.
“Leaders” from both political parties, with precious few exceptions, lack the will- seeing in the flow of easily exploited cheap foreign labor a commodity desired by their wealthy campaign contributors and the potential for flooding the voting booths with voters who will ultimately vote for them. They are willing to compromise America’s national security and endanger the lives and livelihoods of their fellow Americans.
As I have noted in many of my articles and during my appearances before Congressional hearings, the solution to the immigration crisis is for our nation to effectively enforce our immigration laws from within the interior of the United States. Solely focusing on the U.S./Mexican border distracts us from the failures of the vital interior enforcement mission.
As I discussed in another recent commentary, “America the Vulnerable” nearly half of all illegal aliens did not enter the United States without inspection but were admitted through our 328 ports of entry located along both the northern and southern borders of the United States as well as at seaports located along our 95,000 miles of meandering coastline and at international airports located in virtually every state and subsequently violated their terms of admission.
The deadly terror attacks of 9/11, the Boston Marathon bombing, the attack at San Bernardino and the thankfully unsuccessful attack by Faisal Shahzad at Times Square would not have been prevented if the U.S./Mexican border was airtight. All of the terrorists involved in those attacks were admitted into the United States through ports of entry as have been the vast majority of terrorists who have been apprehended in the United States.
On December 10, 2001 former Congressman Tom Trancredo, who had chaired the House Immigration Reform Caucus, placed my prepared testimony into the Congressional Record. I had provided that testimony at a caucus hearing days earlier that was conducted in the wake of the terror attacks of September 11, 2001. In my testimony I noted the need for conceptualizing effective immigration law enforcement as resting on an “Immigration Enforcement Tripod” in which the third leg of that tripod is the effective enforcement of our immigration laws from within the interior of the United States.
Today it is commonplace for hundreds of illegal aliens to raucously demonstrate making their demands known while wearing T-shirts emblazoned with the phrase, “Undocumented, Unapologetic and Un-Afraid.” The fact that foreign nationals have become so emboldened to flaunt their flagrant violations of the very laws upon which rest the security of our nation and the lives of our citizens should make it clear that the next administration must create and environment where our borders are secured and our laws, which provide foreign nationals with their first impression of America, will be truly enforced.
“Deterrence through enforcement” is the solution to the immigration crisis.
