Judge Napolitano Points to the Lie That Could Send Hillary to Jail

In an appearance on America’s Newsroom Monday, Judge Napolitano was asked what’s next after the Capitol Hill hearings on Benghazi. The judge told host Bill Hemmer that Hillary Clinton had “three audiences before her Friday and she forgot about one of them”.

She had the committee, the American public who were listening for “15-second sound bites”, and she forgot about the third, “the 25 or so FBI agents or special prosecutors who were watching.”

The FBI was looking for something called “bad acts,” he said.


Napolitano continued, “In her case the natural proclivity is to lie, whether under oath or not. The more they see of that, the easier it is for them to build a case against her, based on her natural deception.”

Bill Hemmer asked him for specifics.

Napolitano said, “I heard her say to Congressman Pompeo of Kansas, it is late at night. It is about 8:30 or quarter of 9:00. The hearing ended about 10 after –Mrs. Clinton do you know anything about the distribution of weapons to rebel groups? The answer, no. Not only does she know about it, not only did she orchestrate it, but I have seen, anybody can, these are public documents, her personal written authorizations to permit American arms dealers to sell arms to Qatar, knowing they were going to be distributed to rebel groups in Libya because she wanted to topple Gadhafi.”

The judge also mentioned that the Justice Department will make decisions based on political reasons as they did in the case of Lois Lerner.


An International Business Times investigation in May showed that Hillary as Secretary of State in late 2011 formally cleared an enormous arms deal after donations were made to the Clinton Foundation.

News reports documented at least seven foreign governments that received State Department clearance for American arms did donate to the Clinton Foundation while Hillary Clinton was serving as secretary: Algeria, Oman, Qatar, Kuwait, Thailand, Norway and Australia.

During the three full budgetary years of her tenure, Qatar saw a 14-fold increase in State Department authorizations for direct commercial sales of military equipment and services, as compared to the same time period in Bush’s second term. The department also approved the Pentagon’s separate $750 million sale of multi-mission helicopters to Qatar.

Libyan officials were deeply concerned in 2011, as Secretary of State Hillary Rodham Clinton was trying to remove Moammar Gadhafi from power, that weapons were being funneled to NATO-backed rebels with ties to al Qaeda.

The reports included a 16-page list of weapons that Libyans supposedly tracked to the rebels from Western sources or their allies in the region, according to The Washington Times in February.

By July, it was reported that the United States supported the secret supply of weapons to Libyan rebels while Hillary Clinton was Secretary of State according to federal court documents obtained by Fox News.

In July, Judge Napolitano reviewed hundreds of pages of documents and emails related to Hillary Clinton’s tenure as secretary of state.

The judge wrote in a Washington Times column that the documents “persuaded me beyond a reasonable doubt and to a moral certainty that Mrs. Clinton provided material assistance to terrorists and lied to Congress.”

Napolitano said he looked at transcripts from a Fox News interview with an American arms dealer named Marc Turi, in addition to reviewing emails between Turi, State Department officials and lawmakers.

On Fox Business Network, the judge told Charles Payne that he believes a “conspiracy existed” among President Obama, Mrs. Clinton, congressional leaders and other officials to “get arms shipped to rebels in Syria and Libya.”

Napolitano said some of the rebel groups were on the United States’ list of terrorist organizations, so providing “material assistance” to them would be a felony.

Napolitano said arms dealers received permission lawfully from the State Department to sell the weapons to the government of Qatar.
