The Texas federal court that issued a temporary injunction halting Obama’s immigration executive action has just ordered the U.S. government to respond to allegations by the plaintiff States that the U.S. misrepresented to the Court the status of granting deportation waivers, and may thereby be in violation of the court’s temporary injunction.

As explained by John Hinderaker at Power Line, the issue revolves around representations the government made to the Judge, representations called into question by an unexpected “advisory” filed by the U.S. government:

Since Judge Hanen’s order was issued, it has come to light that by the date of the order, the Obama administration had already granted expanded DACA benefits (three years rather than two years) to approximately 100,000 illegal aliens. The Department of Justice disclosed this fact to Judge Hanen in a surprise filing:

In a “Defendants’ Advisory” filed with Hanen’s court late Tuesday, the Justice Department notified the judge that it has already implemented significant parts of the Expanded DACA program, and indeed that it has already granted expanded DACA protections and work permits to “approximately 100,000″ people.

The government’s lawyers essentially admitted that they were disclosing this fact because it was contrary to what they had previously told the court. That has led to a motion by the State of Texas to be allowed to conduct discovery to find out what happened. Here is Texas’s brief in support of that motion.

The Court just ruled this afternoon (Order at bottom of post) that it would not consider the U.S. motion to stay the temporary injunction until a hearing on the possible violations and misrepresentations on March 19.

Unless vacated on an emergency basis by the 5th Circuit, that means the immigration executive action remains on hold for at least another 10 days.

It also means that the extensions to 100,000 illegal aliens, while prior to the injunction, may be in violation of the injunction because the deferral continues.  That is why the U.S. filed the advisory in the first place, to get ahead of the issue and appear to volunteer the information before it was discovered.

A border union chief believes without doubt that we are facing terrorist attacks worse than 9/11 because of the president’s liberal programs which allow people to come into the United States without proper vetting.

National Citizenship and Immigration Service union president, Kenneth Palinkas, said deportations are “extremely down”. The deportation program is “catch and release”, Palinkas explained.

Unless the detainee is convicted of a heinous crime and the person is an aggravated felon, they are detained for about 9 months and..”

The administration gets to decide the disposition of the case. They can no longer bring the case before a judge. As adjudicating officers, they [agents] did have the authority to bring them before an immigration judge. They can no longer do that.

Bad guys getting in is entirely possible. “Now we have homegrown terrorism and now with these other programs that the president wanted to put through, they’re not going to be properly vetted because the people that were going to do the job of vetting these people, remember it’s on an application, it’s not an interview, so you’re only going to get so much information out of that form,” Palinkas said. “You’re only going to have a form and how many documents they submit.”

Thousands of new employees will be hired and inexperienced people will be doing the vetting.

“If this goes unabated, we could be looking at something very scary,” Neil Cavuto said.

Palinkas agreed.

“Absolutely! Coming from all sides, from within and without. That’s the problem we’re faced with.”

“Worse than 9/11,” Cavuto asked.

“Absolutely, I guarantee it will be worse than 9/11,” Palinkas said without question.

“Because we don’t know who the hell is here,” Cavuto asked.

“No, we don’t,” Palinkas answered.

Applications for amnesty are a joke. The sample form below was leaked by an official from the former Border Patrol officers. I don’t know if they’ve been improved but this is where they are coming from.

Treasury Secretary Lew: Raise the Debt Limit Now (by Mitch, Boehner and the Surrender Monkeys)

The U.S. will hit its debt limit on March 16 but with some “extraordinary measures” it will be able to fund the government on a temporary basis, according to U.S. Treasury Secretary Jack Lew, who urged Congress in a letter to raise the debt limit immediately.

In the letter to House Speaker John Boehner and other House and Senate leaders, Lew said on March 13 his office would have to suspend the issuance of some local and and state securities, reports CNBC.

“Accordingly, I respectfully ask Congress to raise the debt limit as soon as possible,” Lew wrote in his letter.

In the letter, Lew assured that increasing the debt limit did not necessarily mean approving new spending but instead allowed the federal government to pay for existing expenses.

His letter came on the heels of a a Congressional Budget Office report Tuesday that said if the U.S. federal debt limit is not raised, the U.S. Treasury Department will exhaust all of its borrowing capacity and run out of cash in October or November, slightly later than a previous forecast. Normal U.S. borrowing authority under the debt limit is due to expire on March 15. If Congress fails to raise or extend the debt limit, Treasury will need to begin employing extraordinary cash management measures to continue borrowing.

It estimated that the Treasury’s extraordinary measures, which range from suspending investments in government employee pension funds to halting sales of debt securities to state and local governments, would provide nearly $363 billion in additional borrowing capacity.

Once that capacity is exhausted, CBO said the borrowing cap “would ultimately lead to delays of payments for government activities, a default on the government’s debt obligations, or both.”

Sharia USA: Delaware Radio Host Fired for Islamic Comments

The norming of sharia. What this radio host said is not unreasonable, and even less grounds for firing, but that is where we are in the US. Perhaps he could have packaged it better, but is that where we are? Yes. Every thought has to be pre-screened and edited for consumption? It’s like we are living in an Islamic country. Shredding the first amendment.

Muslim armies across the world are waging holy war in the cause of Islam. The human toll is unfathomable, the body count daily. American Muslims are flocking to join the jihad and we are not allowed to talk about the threat here at home.

If I lived in Delaware, I would be protesting this radio station. Adding insult to injury or should I say terror to sharia, USA Today asks a terror-linked group, CAIR, for comment. That’s rich, but it illustrates just how twisted this whole conflict has become. My colleagues and I are never asked for comment, but a designated terrorist group is the go-to guy. CAIR insists that it condemns the killing of innocents, but never fully explains that under Islam, non- Muslims are not innocent. Further, while Muslims in the US condemn the Islamic State, where are they teaching against the ideology that gave rise to it?

Nothing is being done to stop jihad recruiting in US mosques, even as several hundred young Muslims from the US have gone to wage jihad for the Islamic State. Why doesn’t USA Today ask CAIR about that?
