Liberal Harvard Law Professor: EPA Climate Rule Is Unconstitutional…

This coming from a liberal at Harvard is saying a lot…

Via Daily Caller:

The Environmental Protection Agency’s proposed rule to cut carbon dioxide emissions from power plants is unconstitutional because it violates the Tenth Amendment and the Fifth Amendment, according to a noted liberal Harvard law professor.

“In short, coal has been a bedrock component of our economy and energy policy for decades,” writes constitutional law professor Laurence Tribe. “The [EPA’s rule] demonstrates the risk of allowing an unaccountable administrative agency to ‘make’ law and attempt to impose the burden of global climate change on an unlucky and unfortunate few.”

“EPA’s singling out of a mere handful of emitters and limiting (or curtailing) their property is exactly the type of overreaching the Fifth Amendment seeks to prevent,” Tribe, who is on retainer for the coal company Peabody Energy, wrote in his comments to the EPA.

WATCHDOG: EXECUTIVE-ORDER PLOY ‘CRIMINAL CONSPIRACY’

Free Republic

NEW YORK – Following confirmation by the National Archives that President Obama did not sign an executive order to implement the immigration policy he announced to the nation, Washington-based watchdog Judicial Watch has called for an investigation into whether the White House has engaged in a criminal conspiracy to spend taxpayer funds on unauthorized purposes.

“The fact that President Obama did not sign an executive order appears to involve a recognition by the White House that President Obama did not have the authority to make the changes in immigration law outlined in his Nov. 20 speech,” said Tom Fitton, president of Judicial Watch.

Fitton, in an interview with WND, argued executive orders are limited to facilitating the execution of laws, not altering or establishing law.

“Barack Obama did not issue an executive order because he does not have the authority to issue an executive order in this instance,” Fitton said

BOMBSHELL: The Media Is Intentionally Hiding This New Benghazi Report

benghazi

Conservative Tribune

Thankfully, there’s still a sliver of media out there who are giving this shocking new Benghazi report some much-needed attention.

The report, completed by the House Intelligence Committee and released on a Friday night by the White House, shows that the Obama administration were absolutely wrong when they blamed the attack on an internet video.

The shocking report specifically stated, “Whatever the larger policy issues, the conclusion that ‘protests’ were fully ‘rooted in a video’ was incorrect, as were the underlying early intelligence estimates concerning the video.”

Texas Muslim Honor Killer Added to FBI’s Ten Most Wanted List

Gateway Pundit

Yaser Abdel Said is accused of fatally shooting his teen daughters to death in an honor killing.

Said told his daughters Aminia, 18, and Sarah, 17, pictured, he was taking them to get something to eat before he shot them dead.

The girls had fled home a week earlier after he said he would kill them for dating non-Muslim boys.

Sarah Said was an avid tennis player known as a silly but bright student. Her 18-year-old sister, Amina Said, was often called “the girl with pretty eyes,” friends say –Star-Telegram.

In 2012 there were reports that Yaser Abdel Said was working in New York City as a cab driver.

This week the FBI added Abdel Said to its Ten Most Wanted List.
Bridget Johnson at Pajamas Media reported:

The FBI added to its Ten Most Wanted Fugitives list an Egyptian sought for the honor killing of his daughters in Texas in 2008.

Yaser Abdel Said, 57, was a cab driver from Lewisville, Texas. The FBI is offering a reward of up to $100,000 for information leading to his arres

The bulletin says the feds suspect Said could have gone back to Egypt or is hiding in Egyptian communities within the U.S.

On January 1, 2008, Said persuaded his estranged daughters Amina, 18, and Sarah, 17, to visit him on the premise he was going to take them to get some food. “Instead, he allegedly drove them in his taxi cab to a remote location and used a handgun to murder them,” the FBI said. “One of the girls was able to make a 911 call and was heard screaming for help, saying she and her sister were being shot by their father. Their bodies were discovered several hours later in the cab, which was abandoned outside a hotel in Irving, Texas.”

According to the Dallas Morning News, Irving police “said they explored all possible motives for the murders” and cited “previous domestic problems” in the family.

Relatives have said that Said physically abused the teens and threatened to kill them after discovering they had boyfriends. “A documentary film about the murders said Said shared a belief held in some parts of the world that women in a family are the property of men,” said the DMN report.

The documentary released this year, The Price of Honor, argues that Said did not flee to Egypt. It also revealed, through Amina’s own communications, her plan to protect her boyfriend from her dad and her prediction that her father would eventually kill her.

The film also argued that U.S. law enforcement mismanaged the case and needs to “raise the bar” on how honor killings are confronted.

Here Congress Goes Again

The Affordable Care Act, aka ObamaCare, was “only” 906 pages long.  A subsequent version of ObamaCare, passed by the U.S. Senate on 24 Dec. 09, was 2,409 pages long.  Ain’t it funny how a bill grows as it becomes a law?  That law spawned over twenty thousand pages of regulations and is being amended as this is being written.

I think that all will agree that there were some surprises in its final version.  For example, remember in 2009 when Obama said, “If you like your health care plan, you’ll be able to keep your health care plan, period.  No one will take it away, no matter what”?  Technically he was correct, but…”You can keep that policy, but you may very well not want to,” said Linda Blumberg, a health economist at the Urban Institute.  Another surprise: remember the “Employer Mandate”?  In order to avoid ObamaCare’s two- to three-thousand-dollar-per-employee penalty for failing to offer qualifying health care coverage, companies offered coverage that did not cover X-rays, maternity care, or surgery as just one cost-cutting option to offset the additional expenses of ObamaCare.

Now we have the National Defense Authorization Act (NDAA) – all 1,648 pages of it. The bill was posted online at 2232 hrs. on Tuesday, 3 Dec. 14. It is scheduled to be voted on as early as Thursday, 5 Dec. 14. Got that? One thousand six hundred and forty-eight pages to read in two days. I don’t think that even Evelyn Wood could read that fast.

What surprises await us with this one? Well, as a taste of what is to come, there are two parts of this bill that have absolutely nothing to do with national defense.

A Surveillance State for Cops

police camera surveillance

Family Security Matters

The dreaded so-called “surveillance state” was held in contempt by many in the media until President Obama announced that he would extend it to police officers. All of a sudden, the idea of the National Security Agency (NSA) targeting the thin blue line between the public and the criminals became a great, “progressive” idea.

Obama euphemistically calls it the “Body Worn Camera Partnership Program [1],” and insists it will “help strengthen accountability and transparency.”

Perhaps these body-worn cameras ought to be used by high-level government officials, in order to sniff out corruption such as the location of missing IRS emails.
